All goods and services made available for bid during the live or silent auction conducted by the Community Foundation for Northern Virginia (Foundation) have been acquired or obtained from third parties. The high bidder acknowledges that the goods or services have not been inspected by the Foundation and is advised that all such goods and/or services are sold “AS IS” with all faults and defects and without any expressed or implied warranty on the part of the Foundation. The Foundation makes no warranties of fitness or merchantability and expressly disclaims the same for all goods and services auctioned.
The Foundation specifically disclaims any and all responsibility or liability for any goods or services presented for bid as part of the auction. Any written warranties within respect to the goods delivered to the purchaser are those solely of the manufacturer or their agents and shall be the sole liability and responsibility of the manufacturer.
With respect to trips, activities or other travel related services offered for bid, the Foundation specifically disclaims any and all liability or responsibility for any damages, losses, injuries, illness or death that may occur or result from the high bidder’s or any invitees’ participation in such auctioned trip, activity or travel experience, including any COVID-19 related exposures or illnesses.
The high bidder agrees to indemnify, defend and hold harmless the Foundation, its officers, directors, employees and volunteers from any against any and all third party claims, actions, causes of action, losses, injuries or damages to persons or property, including illness or death, costs and expenses, including reasonable attorneys’ fees, incurred or to be incurred by the Foundation and which arise out of or result from the high bidder, or any invitees’ participation in the trip, activity or travel experience.
