The following terms and conditions (the “Terms and Condition”) apply to all online auction bidding (“Online Bidding”) and other giving payments made through Clickbid conducted by or in conjunction with the League to Save Lake Tahoe’s (the “League”) virtual benefit fashion show on August 1, 2020 (the “Event”). By registering to participate in Online Bidding and giving, you expressly agree to these Terms and Conditions.
- Registration.
- Before you can participate in Online Bidding or make any other payments through ClickBid, you must register and create a user account with ClickBid (“User Account”). You must be 18 years of age or older to create a User Account. Upon registration and creation of a User Account, you will be issued a unique ClickBid User identification number (“ClickBid ID”).
- You agree to not use any device, software or routine to interfere or attempt to interfere with the proper working of or any transaction being conducted on and during Online Bidding.
- Your User Account details should be kept strictly confidential and you must not permit any third party to use or access your User Account on your behalf or otherwise. You will be liable for any and all bids made via your User Account. The League reserves the right to reject a registration to bid online or make other payments, withdraw permission for you to use Online Bidding or submit payments, and/or terminate your User Account, for any reason at any time prior to, during, or after the Event.
2.Online Bidding.
- Each bid shall be final and binding as soon as the bid button has been depressed. You are strongly advised to examine any lot on which you may bid or have it examined on your behalf before participating in Online Bidding, including the specific terms of each auction lot. There are no mistake bids and bids cannot be retracted. You acknowledge that you are bidding in an auction and you agree that each bid submitted as provided in these terms and conditions is irrevocable and cannot be amended or corrected, even if submitted in error and notified to us. You accept full liability for all bids submitted via your User Account (including the liability to pay in full and on time for any lot that is the subject of a successful bid submitted from your User Account).
- In the event of a tie between a bid placed by you online and any other identical bid(s), the League shall determine the winning bidder in its sole and absolute discretion. The League shall not be liable for any failures, delays, or errors caused by interruptions in the availability of ClickBid, any errors or defects in content or functionality, any software and/or hardware defects, and/or any internet connection problems.
- To determine if have been successful in your Online Bidding, you may check the results on ClickBid. You agree to pay for and collect any auction lot that is the subject of a successful bid submitted by you or from your Online Bidding account in accordance with these Terms and Conditions.
- You assume all risk of loss and damage to property for any purchase using Online Bidding or prizes awarded at the time of payment. You may be responsible for paying applicable taxes and the League shall not provide you with any legal or financial advice.
4. Content.The content displayed on ClickBid, including, without limitation, descriptions of auction prizes and donation lots, may contain inaccuracies and typographical errors. We do not warrant the accuracy or completeness of the content on ClickBid or warrant that any defects will be corrected. Any reliance on any such content, advice, statement, or other information shall be at your sole risk. We reserve the right, in our sole discretion, to correct any errors or omissions in any portion of the Online Bidding service and to make any changes to the features, functionality or content of the Online Bidding service at any time.
5. Amendments to Terms and Conditions.We may from time to time make changes to these Terms and Conditions. Please review these terms and conditions regularly to ensure you are aware of any changes made by us. If you use Online Bidding after changes to these Terms and Conditions have been made and posted, you shall be deemed to have agreed to such changes. If you do not agree to such changes, you should not make any subsequent use of the Online Bidding service.
6.No Warranty. These Terms and Conditions constitute the final expression of the parties’ agreement and a complete and exclusive statement of the terms of the Sale. ITEMS ARE PROVIDED ON AN “AS IS” BASIS WITHOUT WARRANTIES OF ANY KIND EITHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO WARRANTIES OF TITLE OR IMPLIED WARRANTIES OF MERCHANTABILITY OR FITNESS FOR A PARTICULAR PURPOSE, OTHER THAN THOSE WARRANTIES WHICH ARE IMPOSED BY AND INCAPABLE OF EXCLUSION, RESTRICTION OR MODIFICATION UNDER THE LAWS APPLICABLE TO THIS AGREEMENT.
