AUCTION TERMS & CONDITIONS
All artwork in this auction is offered “as is.” Hōlualoa Foundation for Arts and Culture does not make any representations or warranties of any kind concerning the artwork, and will not be responsible for the correctness of the catalog or notices or descriptions of any item, nor will it be deemed to have made any representations or warranty of physical condition, size, quality, rarity, importance, genuineness, attribution, provenance, or historical relevance of any item.
Hōlualoa Foundation for Arts and Culture does not appraise artwork. Fair Market Values of artwork included in this auction are assigned by the donating artist(s), and are not validated by Hōlualoa Foundation for Arts and Culture.
The size of 3D artwork is quoted in each dimension H” x W” x D”. The listed dimensions of 2D work generally reflect the image size as opposed to the framed size. Although we have made every effort to present correct information in auction material, we disclaim all responsibility for any errors or omissions, such as unintended inaccuracies or typographical errors.
REGISTRATION
All bidders must register via the auction website in order to bid on silent and live auction items. Those attending the live auction event will bid by using a bidder number assigned at check-in at the Live event.
SILENT AUCTION
All bidding on silent auction items will happen electronically via the online auction software. You will bid using your cell phone, tablet or computer–there will be no paper bidding sheets. If you are outbid, you will receive communications asking if you’d like to increase your bid. You have won the item if you are the highest bidder at the auction close. Anything paid over the FMV may be considered a tax-deductible donation.
LIVE AUCTION
All live auction bids will happen at the live auction event. Bid by raising your auction catalog with the bidder number facing the auctioneer. The highest bid acknowledged by the auctioneer will be deemed a legal purchase contract. Bidding by proxy is available if you cannot attend the event. Please contact us for details.
PAYMENT INFORMATION
Sales of artwork are subject to the collection of general excise tax (GET) for the State of Hawai‘i at 4.712%. Out-of-state buyers having purchases shipped directly to their home state may qualify for an exception.
The highest bidder for each item will be responsible for payment on the day of the auction by check or credit card (American Express, VISA, or MasterCard). ALL PURCHASES ARE FINAL.
Hōlualoa Foundation for Arts and Culture is a 501(c)3 nonprofit organization. Any amount paid over the estimated retail value of a piece may be deductible as a charitable contribution. Please consult your tax advisor.
SHIPPING & PICK-UP
At the auction’s close, all artwork will remain in the care of Donkey Mill Art Center until secured and professionally packaged. Winning bidders must choose from the following options: (1) Shipment*, or (2) Pick Up their artwork at Donkey Mill between the hours of 10:00am - 6:00pm from Wednesday - Saturday, March 18 - 21, 2026.
*Shipping Off-island may be arranged with the Donkey Mill Art Center for an additional fee. We are unable to provide shipping quotes in advance of the auction. The Mill will contact the winners with their shipping quotes and options after the event and item packing are complete.
