If you and your family would like to participate in the One Mile Patriotic Walk starting at 9:00 a.m. at the Brighton Mill Pond and receive a t-shirt with lunch once the full Ruck march returns to downtown approximately noon. Please register each person participating with your family to help us with counts for meals unless under 6 years old (eat free with paid adult). All other adults/children can be registered to receive a t-shirt and lunch. Thank you for your support and we will see you at the one mile walk. Check in at the registration table to receive your t-shirt and ticket for lunch.
PARTICIPANT WAIVER AND RELEASE OF LIABILITY
In consideration of the opportunity to participate in the Ruck for Life (henceforth referred to as “Event”), as organized by Veteran Connected, whose registration process requires me to accept this agreement, and, therefore, I, _______________________________, as Participant in the aforementioned Event, hereby agree to the following Participant Waiver and Release of Liability (henceforth referred to as “Agreement”):
1. Waiver and Release of Liability: My participation in the Event is voluntary and subjects me to the possibility of physical injury (which could be minimal, serious, and/or result in death) and loss of or damage to my property (collectively referred to as “Risks”). Accordingly, I agree to the following:
A. I hereby release and hold harmless Veterans Connected and their representatives from any claim, demand, loss, liability, damages, and attorney fees and costs whatsoever arising from, related to, or resulting from these Risks (Claims), including those caused by the negligent acts or omissions.
B. I recognize the physical exertion involved in the Event and attest and certify that I am physically fit to participate safely, and I have not been advised otherwise by a health care professional.
C. As between Veterans Connected and me, I will be solely responsible for any and all medical and related bills that I may incur because of any injury, as well as costs related to loss or damage to my property, that I may sustain as a result of my participation in the Event, including those sustained while the Event is conducted and while I am traveling to and from such premises, regardless of the location or mode of transportation.
D. I recognize that in my participation in this Event, if I may violate certain local, state, or federal orders, statues, or laws, and that I will be solely responsible for any and all legal action that may be taken against me as a result of my participation.
E. This Agreement shall be binding on my estate, heirs, executors, administrators, successors, and assigns, as well as any other party asserting a Claim on my behalf or on behalf of my estate.
2. General Provisions:
A. I hereby expressly agree that (1) this Agreement shall be governed and construed according to the laws of the state of Michigan without regard to its conflict of laws provisions and (2) any action or proceeding concerning any Claim or the meaning or effect of any provision of the Agreement shall be conducted only in the federal or state courts located in Detroit, Michigan, and that for such purposes, I expressly submit to the jurisdiction of such courts.
B. This Agreement contains the entire understanding between and among the parties concerning these matters. No waiver, modification, or amendment of any of the terms of this Agreement shall be effective unless made in writing and signed by the party to be charged.
C. I hereby expressly agree that if any portion of this Agreement is held invalid, the balance of the Agreement shall nonetheless continue in full legal force and effect.
3. PUBLICITY CONSENT AND RELEASE
a. By signing below, I give Veterans Connected permission to take video and audio recordings, photographs and digital images, and the like (collectively referred to as “Images”) of me recorded on September 28, 2024 at the Veterans Connected Ruck March event held in Brighton, Michigan. I agree that Veterans Connected has complete ownership of such Images, including the entire copyright, and I agree that Veterans Connected may use edit, copy, publish, store, use quotations from or distribute these Images without my prior review, without any additional consent, and with or without my name for any lawful purpose, including but not limited to internal and external communications, publications, advertisements, marketing, and promotional or educational materials, in any medium (collectively referred to as “Materials”). I also consent to Veterans Connected sharing these Images, Materials, and quotations with Veterans Connected affiliates and on social media for these purposes. I waive any right any compensation or royalties for the use of such Images and quotations and hereby release Veterans Connected and its affiliates from any and all claims which arise out of or are in any way connected with such use.
I warrant that I have read and understand that this Agreement involves my waiver and release of significant rights and my assumption of significant indemnification responsibilities in participating in the Event.
