Terms and Conditions for Online Auctions / User Agreement:
Bidders and Auctioneer agree that the terms and conditions set forth below shall govern this online auction.
All registration information provided by Bidders to Auctioneer shall be current, complete, and accurate. Bidders must be 18 years of age or older. Bidders agree to not use any device, software or routine to interfere or attempt to interfere with the proper functioning of this online auction sale.
Bidders acknowledge that this online auction is conducted electronically and that the Auctioneer and other parties to the online auction will therefore of necessity rely on hardware and software that may malfunction without warning.
By accessing this site, you agree to accept, without limitation or qualification, all of the terms and conditions of the site user agreement and to comply with all applicable laws, statutes, ordinances and regulations regarding your use of this site.
Eligibility:
Our services are available only to individuals who can enter into legally binding contracts under applicable law. Without limiting the foregoing, our services are not available to minors. If you are a minor, you may use our services only in conjunction with your parent or legal guardian. If you do not qualify, please do not use our services. Further, your account and user ID may not be transferred or sold to another party. If you are registering as a business entity, you represent that you have the authority to bind such entity to this Agreement.
Your Information:
You are solely responsible for providing accurate information that will be used to identify you to this online auction system, to deliver notices to you and to allow Feeding America Eastern Wisconsin to contact you. If your contact information changes, then you are responsible for updating it. Feeding America Eastern Wisconsin will not be responsible for lost, delayed or misdirected notices in the event you do not update your information in a timely manner. Our use of email addresses is strictly for contacting Bidders; any use of this private information by anyone else or for any other reason is strictly prohibited.
Online Bidding:
Once registered, you are solely responsible for keeping your account details strictly confidential and you must not permit any third party to use or access your account on your behalf otherwise. You will be liable for any and all bids made via your account. You agree to pay for and collect any item/package that is the subject of a successful, winning bid submitted by you or from your online bidding account.
There are no bid retractions. All bids are non-cancellable once submitted. Once a bid is made and confirmed, it cannot be retracted. When a bid is made you manifest your intent and ability to buy the item/package at the bid price.
If you intend to buy an item offered in a fundraising event, you agree that you are obligated to complete the transaction with the seller (unless the transaction violates the law or these Terms) if: (a) you are the highest bidder for an item at the end of an auction (assuming you meet any minimum bid or reserve requirements for the specific auction), and your bid is accepted by the seller; or (b) you purchase an item that is offered for a fixed-price. Payment will be due immediately upon the completion of the auction for your item. If applicable, you agree to pay any sales, use or value added tax on your purchase, as well as any shipping or delivery charges. You should be aware that the seller may include sales conditions or other terms in the item’s description. You should be sure to read the description carefully, because by bidding on the item you are agreeing to all the terms contained in the description (unless any of the terms violate these Terms or applicable law).
Stated values for the auction items are provided by the donors and are not guaranteed by Feeding America Eastern Wisconsin. All sales are final and items are sold as is. Feeding America Eastern Wisconsin staff will decide any items under dispute and have final authority. Feeding America Eastern Wisconsin reserves the right to amend these rules.
