Event Details

Beginning Thursday, December 14, 2023 at 11:00AM EST, the public has the opportunity to bring home one of “Twinkle Town’s” 14 incredible trees in time for the holidays during Gardner White’s first ever, Twinkle Town online auction. 

100% of funds raised will benefit each tree’s charity partner. This is your chance to own your favorite tree while making an impactful donation.

Registration is required to participate. Bidding closes at 11:59PM EST on Sunday, December 17, 2023.

At the close of the auction, the winner(s) will be notified by Gardner White via text, phone, and/or email. Once the winning donation has been processed by the charity partner, a pick-up time will be scheduled at the Gardner White location at 6500 E. 14 Mile Road in Warren, Michigan between 10am EST-8pm EST, Wednesday, December 20-Saturday, December 23, 2023.

Terms and Conditions

Gardner White Furniture, Inc. Twinkle Town Tree Auction

Bidding will begin and end at designated times. Bidding will begin on Thursday, December 14, 2023, at 11:00 AM EST. Bidding will end on Sunday December 17, 2023, at 11:59 PM EST.

Bidding on Items: You must be a registered user to bid on items. Individuals must reside within the United States of America to register to bid online. By bidding, you are stating that you are ready and willing to purchase that item for your bid amount. If you are outbid, or your bid does not meet the reserve price, you are under no obligation to buy. But in all other cases, you are entering a contract to buy the item, and to deliver payment within the time period specified (24 hours from auction closing). If you cannot pay, please don’t bid. Your bids are final and non-retractable. Auction items will not be released to winning bidder until the charity partner has received payments in full.

Auction items are priced based on their fair market value. FMV is $1700.00.

Limits may apply. All auction items include what is seen in the photo, unless otherwise noted in exclusions. Items are sold as-is.

Bidding will begin at $500.00.  Bids must meet the minimum open bid requirement of $500.00 (or risk disqualification). Minimum bid increments are set for $25.00. Bidder has the option to buy the auction item outright at $7,500.00. Bidders can bid multiple times on the same item if they meet the minimum bid requirement of $500.00.

Bidder Registration: All persons who wish to bid in the auction or want to purchase must register by creating an online account. To register, the Bidder must provide all the registration information requested. Bidders must be 18 years of age or older and have a valid driver’s license. We reserve the right to refuse to register or admit any person at our sole discretion. Invoices and correspondence relating to purchases will be sent in accordance with the information on the bidder’s registration. Your registration will be accepted but your information will be verified, and your account may be disabled until the necessary information is provided to verify the account.

Bidder Rights: All rights granted herein are personal and exclusive to the registered bidder and may not be assigned or transferred to another person or entity, by operation of law or otherwise. Any attempt to assign or transfer any such rights shall be void and unenforceable. No third party may rely on any benefit or right conferred herein or granted to any Bidder. Internet Bidding

(A) Buyer acknowledges that Gardner White Furniture, Inc. does not have any responsibility or liability for the website(s) used for Internet bidding. Seller acknowledges that Gardner White Furniture, Inc. may not have any control over the website(s) and cannot guarantee its operation or performance. There are occasional interruptions and delays relating to the use of the Internet and the Website. Furthermore, Gardner White Furniture, Inc. shall not be held liable (for lost profits, special damages or otherwise) or responsible for the function of the website or its inability to function. Buyer acknowledges that hardware malfunctions, software malfunctions, viruses, and similar issues do occur and are beyond the knowledge, scope, and control of Gardner White Furniture, Inc.

(B) The website is administered by Clickbids from its offices in the United States of America. Individuals must reside within the United States of America to register to bid online. Gardner White Furniture, Inc. will not accept bids from individuals who reside outside of the United States of America and its territories. If you access the website from a location outside of the United States of America and its territories, Buyer consents to exclusive and continuing jurisdiction in the United States of America and agrees to be bound by and comply with all applicable laws.

(C) Gardner White Furniture, Inc. reserves the right to deny any person for any reason permission or access to bid online.

(D) Winning bidders will be notified via text, email or phone call on Monday, December 18, 2023.

 Gardner White Furniture, Inc. disclaims any liability for damages, whether direct, indirect, consequential, or incidental, resulting from bids not spotted, executed, or accepted. Bidders should also be careful to bid on the correct lot and ensure that his/her bid is for the amount intended. Gardner White Furniture, Inc. is not responsible for computer or human error which may result in any customer dissatisfaction. We reserve the right to accept or reject any and all bids or bidders. The sale is complete when Gardner White Furniture, Inc. so announces.

Items may change or be withdrawn without notice.

Winning bidders will be determined at the end of the auction on Monday, December 18, 2023, at 12:10 AM EST. The winner of each auction item is determined by Gardner White Furniture, Inc. who will, in its sole discretion, determine who has the highest recorded bid at the close of the auction or who chose the “Buy Now” option.

Winning bidders will be contacted on Monday, December 18, 2023, by the respective charity partnered with that auction item. Winning bidders must process payment for their auction item with the charity organization directly. Once final payment has been made and confirmed, Garnder White will contact the winning bidder to coordinate a date and time for pick-up of their auction item. Pick-up dates and times will be available Wednesday, December 20 through Saturday, December 23, 2023, between 10:00 AM and 8:00 PM EST at the customer pick-up area at Gardner White Furniture, Inc.: 6500 E 14 Mile Road, Warren, MI 48092. If Gardner White Furniture, Inc. is unable to contact the winning bidder or receive a response promptly from a winning bidder, GW may elect to designate the next highest bidder as the winning bidder or to pull the item from the auction.

Acceptance of Terms: A bid placed by any person shall be conclusive proof that he or she acquainted himself or herself with the terms and conditions of sale and agreed to be bound by such terms and conditions prior to placing any bid.

Breach of Contract: If this Agreement, or any terms and conditions announced by Gardner White Furniture, Inc., are not complied with, in addition to other remedies available to the seller by law, including without limitation, the right to hold the Buyer liable for the bid price, Gardner White Furniture, Inc. may: (1) publicly or privately resell the property, with the non-complying Buyer being held liable for the payment of any deficiency purchase price, plus all costs incurred; and/or (2) cancel the sale and retain as liquidated damages all payments made by the non-complying Buyer. Gardner White Furniture, Inc. all incidental damages, expenses, court costs, costs of collection, and/or attorneys’ fees will be charged to and be the responsibility of the non-complying Buyer.

Limitation of Liability: IN NO EVENT SHALL GARDNER WHITE FURNITURE, INC. BE LIABLE TO BUYER FOR ANY INDIRECT, SPECIAL, OR CONSEQUENTIAL DAMAGES OR LOST PROFITS ARISING OUT OF OR RELATED TO THIS AUCTION OR THE PERFORMANCE OR BREACH THEREOF GARDNER WHITE FURNITURE, INC.S’ LIABILITY TO A BIDDER SHALL IN NO EVENT EXCEED THE TOTAL OF THE PURCHASE PRICE, BUYER’S PREMIUM, AND TAXES PAID BY BIDDER TO COMMUNITY AUCTIONS, REGARDLESS OF WHETHER BUYER’S CLAIM IS BASED ON CONTRACT, TORT, STRICT LIABILITY, OR OTHERWISE. BUYER ACKNOWLEDGES THAT THEY ARE PURCHASING “AS-IS” AND UNDERSTANDS THERE ARE NO REPRESENTATIONS OR WARRANTIES WHATSOEVER, INCLUDING WITHOUT LIMITATION, FITNESS FOR A PARTICULAR PURPOSE.

Note that the successful bidder’s information may be used and disclosed as part of the fulfillment process.

Interpretation: Each party to this Agreement acknowledges that it has read, or has had the opportunity to read, the terms provided herein. The parties agree that this Agreement reflects the terms as agreed to by the parties hereto. In the event a term or terms is considered ambiguous, neither party hereto, nor their respective counsel, will be considered the draftsperson of this agreement for the purpose of causing the terms of this Agreement to be construed against a party hereto.

Applicable Law: The parties hereto acknowledge and agree that this Agreement is made and entered into in the State of Michigan, Macomb County and will in all respects be interpreted, enforced, and governed under the internal laws (and not the conflicts of laws) of the State of Michigan. In the event that the parties hereto, or anyone of them, litigate any actual or potential breach of this Agreement, the parties hereto stipulate and agree that the exclusive and continuing venue for any such action will be in Macomb County, State of Michigan, or the United States District Court, located in the State of Michigan.
