SILENT AUCTION RULES
General Auction Information & Rules
- All silent auction items and services must be paid for in full by Sunday, March 2, 2025.
- Online purchases can be paid for by card: MasterCard, Visa, Amex, or Discover.
- All bids are binding.
- All sales are final. There will be no refunds. Our auction is a nonprofit fundraiser benefiting Eton Academy students.
- Gift certificates and services are good for one year from the auction unless otherwise specified and are subject to any terms and conditions set forth by the donors.
- A successful bidder is obligated to contact the donor of services within two weeks of the auction or sooner, if specified, in order to arrange dates/reservations. Eton Academy is not responsible for a bidder’s failure to reserve/redeem an item within the time specified.
- Every reasonable effort has been made to describe each item and service correctly.
- By purchase, the buyer waives any claim for liability against either Eton Academy or the donor.
- All items and services are sold “as is” and without warranty or representation of any kind as to the correctness of description, authenticity, condition, quality or fitness for any purpose. There is no discount for damaged items.
- Dollar values for items and services listed in this catalog are estimates provided by the donors, and are not warranted by Eton Academy for tax purposes or fair market value.
- We reserve the right to have our agent bid on our behalf to protect the sale price of certain items.
- No bids will be accepted after the Silent Auction has closed.
- The closing bid identified by an Eton official constitutes the winning bid.
- No auction donation of merchandise or service can be purchased for less than the opening bid.
NON-WARRANTY AND DISCLAIMER OF LIABILITY
GOODS - All goods covered by this invoice have been acquired or obtained by Eton Academy from third parties. THE GOODS COVERED BY THIS INVOICE ARE SOLD AS IS, WITH ALL FAULTS AND DEFECTS AND WITHOUT ANY EXPRESSED OR IMPLIED WARRANTY ON THE PART OF ETON ACADEMY, INCLUDING BUT NOT LIMITED TO WARRANTIES OF FITNESS AND MERCHANTABILITY. ETON ACADEMY ACCEPTS NO RESPONSIBILITY OR LIABILITY FOR THE PRODUCTS’ DESIGN OR USE. Any written warranties with respect to the goods delivered to the purchaser are those SOLELY of the manufacturer of same.
SERVICES - All services covered by this invoice have been acquired or obtained from and are to be furnished by third parties. No services covered by the invoice are to be or will be performed by Eton Academy. Eton Academy SHALL BEAR NO RESPONSIBILITY FOR THE DELIVERY OR QUALITY OF ANY SUCH SERVICES OR FOR ANY LOSS OR DAMAGE ARISING FROM, RELATED TO OR CONNECTED WITH THE PERFORMANCE OF OR NON-PERFORMANCE OF SUCH SERVICES. THE PURCHASER FURTHER ACKNOWLEDGES THAT IN THE EVENT SERVICES PURCHASED ARE OUTSIDE OF THE UNITED STATES, ETON ACADEMY CANNOT BE RESPONSIBLE OR LIABLE FOR ANY POLITICAL UNREST OR INSTABILITY THAT MAY OCCUR OUTSIDE THE CONFINES OF THE UNITED STATES NOR CAN ETON ACADEMY BE HELD ACCOUNTABLE FOR ANY INJURIES OR DAMAGES THAT MAY ARISE THEREFROM. PURCHASER FURTHER ACKNOWLEDGES THAT HIS PURCHASE IS NON-REFUNDABLE UNDER ANY AND ALL CIRCUMSTANCES AND THAT SHOULD LEGAL ACTION BE REQUIRED TO COLLECT FOR THE GOODS OR SERVICES PURCHASED BY THIS INVOICE, THEN THE PREVAILING PARTY SHALL BE ENTITLED TO ANY AND ALL REASONABLE ATTORNEY’S FEES AND COSTS.
